FINDITBAY TERMS OF USE

1. ABOUT FINDITBAY AND THESE TERMS
Finditbay ("Finditbay," "we," "us" or "our"), based in British Columbia, Canada, operates finditbay.com (the "Site"). These Terms govern use of the Site and the features we make available through it, including our articles, guides, product recommendations, guide assistant and optional web-push notifications. Provisions about newsletters, comments and reviews apply to existing records or when those features are offered; this website version has no newsletter signup or public-submission form.
Finditbay publishes practical ideas for small-space living, everyday hosting and seasonal projects. We earn income through affiliate relationships. We do not currently sell products, take payment for merchant purchases, or fulfill orders. Purchases made after following our links take place on merchants' websites.
Please read these Terms before using the Site. Where these Terms are brought to your attention and you agree to them, they form the agreement governing your use. Where we ask you to accept these Terms before using an interactive feature, you must do so to use that feature. If you do not agree, do not use that feature or submit content through it.
Our Privacy Policy explains our handling of personal information. Accepting these Terms is not blanket consent to optional tracking, marketing emails or unrelated uses of personal information.
Nothing in these Terms takes away a right, protection or remedy that applicable law does not allow you to waive.
2. INTENDED AUDIENCE
Our present editorial market is Canada and the United States. We do not currently target or market our services to people in the EEA or UK. We may restrict optional tracking and interactive features by region. Geographic restrictions do not remove mandatory privacy or consumer rights.
The Site is intended for adults. You must have reached the age of majority where you live to subscribe to our newsletter, submit a comment or review, or use the chatbot. If you act on behalf of a business, you must have authority to do so.
The Site is not directed to children, and our interactive features are not intended for their use. Do not submit a child's personal information through those features.
3. INFORMATIONAL CONTENT AND PRACTICAL SAFETY
Our content is general information to help you explore ideas and products. It is not advice tailored to your home, health, finances or other individual circumstances, and does not create a professional advisory relationship.
Our product recommendations are currently based on research. Unless a particular article expressly states otherwise, do not assume that we purchased, physically inspected or personally tested a featured product. Descriptions may draw on manufacturer or merchant information and other research sources. We aim to distinguish those sources from our own assessment.
Before relying on content or starting a project, check the product's current instructions, warnings, dimensions, specifications and suitability for your circumstances. Follow applicable building, electrical, fire, food-safety and other requirements. Obtain qualified professional help for work requiring specialist skill. Keep relevant risks to children, pets and people with allergies or other vulnerabilities in mind.
Images, styling examples and illustrations may show ideas rather than the exact item, scale or result you will receive. Any illustrative or AI-generated depiction should not be treated as evidence of product performance or personal testing.
We seek to provide useful information, but content can become outdated or contain mistakes. Prices, stock, shipping, eligibility, specifications, savings claims and promotional terms may change. 4. AFFILIATE RELATIONSHIPS AND EDITORIAL DISCLOSURES
Finditbay participates in Amazon Associates and Benable. We may add other affiliate programs, identified with relevant content or in our affiliate disclosures. We may earn a commission when you follow an affiliate link and make a qualifying purchase or complete another qualifying action. Commission arrangements vary by program.
As an Amazon Associate I earn from qualifying purchases.
Placement and ranking of recommendations are primarily based on our research. Affiliate relationships create a financial interest that you should consider when evaluating our recommendations. A list does not necessarily cover every available merchant or product, identify the lowest price, or determine what is best for every reader.
Finditbay does not currently accept sponsored placements. If we introduce them, we will identify paid placements clearly and update relevant disclosures. Material connections, including any free products or other benefits connected to a recommendation, will be disclosed where applicable.
A recommendation expresses our editorial assessment; it is not a product warranty. The presence of a merchant's name or trademark does not mean that the merchant has endorsed Finditbay.
5. MERCHANTS, OFFERS AND THIRD-PARTY SERVICES
When you follow a merchant or affiliate link, you may pass through an affiliate network before reaching a separate website. That service's terms and privacy practices apply to your interaction with it.
Your purchase agreement is with the merchant. The merchant is responsible for taking payment, supplying the item, delivery, warranties, returns, refunds and customer service associated with that transaction. Direct order questions to the merchant. We cannot promise that a merchant will accept an order, honor an advertised offer, or resolve a dispute in a particular way.
We do not control independent merchants or their websites. This explanation does not exclude responsibility that the law imposes on Finditbay for its own statements or conduct.
Any price, promotion or availability shown on the Site is informational. The merchant's current checkout information and applicable terms determine its offer, subject to your legal rights. Consider taxes, delivery charges, duties, currency conversions and geographic restrictions before buying.
6. GUIDE ASSISTANT
Our guide assistant selects excerpts from Finditbay guides, seasonal pages and a scripted FAQ knowledge base. It is available in Canada and the United States where enabled. This release does not use a generative language model or another website’s private content.
The guide assistant is an automated information tool, not a human adviser. It selects stored answers and links to their sources; it may select an irrelevant answer, and stored content may be incomplete or outdated. It does not check live prices, inventory or merchant accounts. A new question is processed independently of earlier questions.
Check important information against the cited source, manufacturer or merchant. Do not treat a chatbot answer as evidence that Finditbay has tested a product, a personalized professional recommendation, a binding offer, or authority to act for a merchant.
The chatbot cannot place orders, make purchases or commitments for you, or change these Terms. Do not use it for emergencies or decisions requiring qualified professional advice. Affiliate recommendations in chatbot responses remain subject to our affiliate-disclosure obligations.
Do not submit passwords, payment-card details, government identification numbers, sensitive health information, confidential business material, or personal information about another person. You must have the right to share any material you enter. This restriction does not remove our obligations under applicable privacy law if personal information is received.
Read the chatbot's notice and our Privacy Policy before use. They must explain the service providers, processing purposes, retention and any model-training use applicable to your inputs. Agreement to these Terms does not by itself authorize use of your conversations to train a general-purpose AI model.
7. PERMITTED USE AND INTELLECTUAL PROPERTY
Subject to these Terms, you may access the Site for lawful personal, noncommercial use and save or print reasonable portions for your own reference. Keep relevant copyright, attribution and disclosure notices intact.
You may share links to our pages without suggesting a false affiliation or endorsement. Use any sharing function according to its stated scope. Our permission does not extend to rights held by others in photographs, trademarks, product descriptions or other licensed material.
Finditbay or its respective licensors retain their rights in original content, branding, design and software. Except as permitted by law or a relevant license, you must obtain permission before republishing substantial content, commercially exploiting it, or copying the Site or its databases.
Nothing in these Terms restricts fair dealing, fair use, accessibility rights or another use that applicable law protects. We do not claim exclusive ownership of facts, ideas or material for which exclusive rights do not exist.
8. ACCEPTABLE USE
You must not: - Use the Site for fraud, impersonation, unlawful activity or misleading commercial promotion. - Submit malware, spam, malicious links, unlawful threats, harassment, or material infringing another person's privacy or intellectual property rights. - Attempt unauthorized access, evade access restrictions, manipulate affiliate attribution, or interfere with the security or availability of the Site. - Harvest personal information from visitors, comments or reviews for unsolicited marketing or other unauthorized purposes. - Fabricate reviews, impersonate a purchaser, conceal a material commercial connection, or manipulate ratings. - Use automated extraction to impose unreasonable loads, bypass controls, or reproduce protected content for a competing database or service without permission or other lawful authority. - Use protected content for commercial AI training or bulk redistribution without permission or other lawful authority.
These restrictions do not prohibit ordinary search-engine indexing that respects applicable access instructions, permitted sharing, assistive technologies or uses protected by law. They also do not prohibit honest criticism, lawful reviews, or reporting concerns to regulators or law enforcement.
9. USER-GENERATED CONTENT (UGC): COMMENTS, REVIEWS AND OTHER PUBLIC SUBMISSIONS
“UGC” means material you choose to submit for public display through an available Site feature, such as text, reviews or permitted images. Do not submit AI-generated material as a false account of personal experience or a verified purchase. Identify a material commercial relationship, incentive or conflict connected with a review.
If you submit material for public display, you remain responsible for what you submit and retain any ownership rights you hold. Submit only material that you have the right to share. Make clear whether a review describes your own experience or information obtained elsewhere, and disclose relevant relationships with a product or merchant.
By submitting content for public display, you grant Finditbay a non-exclusive, worldwide, royalty-free license to host, reproduce, format and display it on the Site, and allow our service providers to do so solely to operate the feature. We may moderate or make non-substantive formatting edits, but will not knowingly alter the meaning of a review to misrepresent your views.
This permission does not authorize using your name, image or statement in a separate advertising testimonial, or licensing your submission for unrelated AI training. We will seek any additional permission needed for those uses.
Public submissions and your chosen display name may be visible to anyone and indexed by search engines. Do not include private contact details or information you do not want public. Private emails and chatbot conversations are not public submissions under this section; their handling is described in the Privacy Policy.
We may reject, hold for review, label or remove material for breaches of these Terms, spam, duplication, irrelevance, security, legal obligations or reasonable and consistently applied moderation needs. We may use automated screening with human review where appropriate. Publication does not mean that we verified or endorse a submission. We do not knowingly present fabricated reviews, make incentives conditional on positive sentiment, or suppress honest negative reviews to mislead readers. No general obligation to monitor every contribution is assumed beyond applicable law.
We may restrict repeat misuse and provide a reasonable opportunity to query an apparent moderation error at [email protected]. Statutory content-notice and appeal procedures take priority where applicable. Negative feedback is not, by itself, a reason for removal. We do not promise to review every submission before it appears.
You may request removal at [email protected]. When we remove a submission, the display license ends except to the extent necessary for restricted backups, legal obligations or resolving a dispute. Removal cannot guarantee deletion of independent copies already made by others. Statutory privacy and removal rights remain unaffected.
10. NEWSLETTERS AND FUTURE MESSAGING
Newsletter subscriptions are optional. You may unsubscribe using the link in a marketing email or by contacting [email protected]. Unsubscribing does not prevent necessary non-promotional replies to your inquiries or legally required notices. We will not treat a comment, chatbot interaction or ordinary inquiry as automatic enrollment in marketing emails.
Installing the available web app does not subscribe you to push notifications. Push requires the separate notification choice and browser permission described on Install & notifications. You can unsubscribe there or in browser/device settings. This release does not operate SMS marketing. Email, push and SMS choices are separate from optional analytics and advertising choices.
11. REPORTING CONTENT OR RIGHTS CONCERNS
Send concerns about accuracy, unlawful content, copyright, privacy or accessibility to [email protected]. Identify the relevant page or content, explain the concern and provide enough contact information for us to respond. For a rights complaint, describe the work or right involved and your authority to act.
We may seek clarification and take appropriate steps under applicable law. Contacting us is not a prerequisite to exercising a legal right or approaching a regulator.
12. AVAILABILITY AND CHANGES TO FEATURES
We may update, suspend or discontinue features or content for operational, security, legal or editorial reasons. We may restrict access where reasonably necessary to address misuse or protect the Site and its users. Where appropriate and practicable, we will provide notice and an opportunity to raise an error with us.
New features may require additional information, notices or terms before use. These Terms do not enroll you in a paid service, authorize a purchase, or give advance consent to future tracking or marketing practices.
13. WARRANTIES AND LIMITS OF RESPONSIBILITY
To the extent permitted by applicable law, we provide the Site and its informational content on an "as available" basis. We do not guarantee uninterrupted availability, error-free information, complete market coverage, or that a product or idea will meet your particular needs. Any implied warranties or conditions are excluded only to the extent their exclusion is lawful.
To the extent permitted by applicable law, Finditbay is not liable for indirect or consequential losses, or loss of business profits, arising from use of the Site. For consumers, this exclusion does not extend to direct, reasonably foreseeable loss for which applicable law makes us responsible.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, deliberate misconduct, gross negligence, death or personal injury caused by negligence, breach of a non-excludable privacy or consumer obligation, or any other liability that cannot lawfully be excluded or limited. Nothing shifts responsibility for Finditbay's own legally actionable conduct to you or an independent merchant.
The rights and remedies available under applicable mandatory law prevail over any inconsistent wording in these Terms.
14. GOVERNING LAW AND DISPUTES
Subject to mandatory law that applies to you, these Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there. This choice does not deprive a consumer of mandatory protections available under the law of their place of residence.
Courts in British Columbia may hear disputes, but this is not an exclusive forum requirement that prevents a consumer from using a court or tribunal available under applicable law. These Terms do not require arbitration, waive participation in class proceedings, shorten a statutory limitation period, or prevent a complaint to a regulator.
You may contact [email protected] to seek an informal resolution. Doing so is optional and does not suspend a legal deadline unless we expressly agree in writing or the law provides otherwise.
15. CHANGES TO THESE TERMS
We may revise these Terms as the Site or legal requirements change. We will update the date below and give reasonable, prominent notice of material changes, with advance notice where required. When the law or the nature of a change requires renewed agreement, we will obtain it before applying that change to you.
Changes operate prospectively and do not retroactively remove accrued rights. A revised privacy notice does not itself provide consent for a new use of personal information.
16. GENERAL PROVISIONS
If a provision is unenforceable, it will be limited or separated only to the extent permitted by law; the remaining provisions continue to apply. A failure to enforce a provision on one occasion is not a waiver for all future occasions.
These Terms and any feature-specific terms you validly accept govern use of the Site. They do not override the Privacy Policy's protections, mandatory law, or a separate written agreement we enter into with you. A specific feature's terms prevail for that feature only where lawfully agreed and consistent with your mandatory rights.
Provisions intended by their nature to continue after use ends, including applicable intellectual property, responsibility and dispute provisions, continue only to the extent legally enforceable. No provision extends a license or data-retention period beyond its stated limits.
17. ACCESSIBILITY AND LANGUAGE
Contact us if you need help accessing these Terms or understanding a Site feature. We will consider reasonable requests for an accessible format. Any language rights provided by applicable law remain intact; these Terms do not require you to waive them.
